1. Market Situation

 

□ Indonesian consumers are becoming more aware of the positive impact of nutritional products. The outbreak of diseases has opened a new market for importers and distributors of Indonesian food supplements. Given its 240 million populations and this rising interest, Indonesia is a good potential market for health food supplements.

 

□ The expansion of the health food market parallels the trend in the health care in Indonesia from medication to prevention, using non-prescription over-the counter(OTC) preparations. The rise in health care costs, the changes in diet and lifestyle and the aging population contribute to the increasing demand for food supplements. People continue to consume food supplements to boost their immune system and to strengthen their body. The awareness of the positive effects of vitamins and food supplements on health has contributed to the increase in sales for food supplement products. Indonesian consumers often turn to self-medication and food supplements because they have become a less expensive alternative.

 

□ Indonesia’s health food market features imported and locally produced products. The imported food supplement market is concentrated in Jakarta, Bandung, Surabaya, and Medan.

 

□ According to Asosiasi Pengusaha Suplemen Kesehatan Indonesia(APSKI), there are approximately 200 pharmaceutical companies as producers food supplements and 30 direct selling that sell using multi-level marketing(MLM). But only 40 were joined in APSKI. Then it is hard to handle some of Indonesia food supplement(FS) producers which is produce sub-standard quality FS. The effect is some countries are doubting food supplement from Indonesia. The government through Indonesia’s food and drug agency will control and monitoring the production tighter.

 

□ Domestic producers produce mainly herbal health drinks, Indonesian traditional herbs(jamu) and health food products originating from raw materials available in Indonesia. In general, locally produced health foods do not compete directly with imports, because they appeal to different market segments. Locally produced health foods appeal to a down-market segment. Indonesia traditional herbs(jamu) are not classified as food supplements.

 

□ U.S. health food supplements have sterling reputation in Indonesia. It accounted for about 70% market share in Indonesia. It means when market for health food supplements in Indonesia was estimated at US$ 313 million in 2008, the imported (U.S.) products accounted for US$ 180 million.

 

□ According to Global Trade’s data, best sales prospect include:

 

 ○ Diet and aesthetics products or items that enhance physical appearance, including weight loss or weight gain.

 

 ○ Degenerative prevention products or items that prevent degenerative diseases such as cardiovascular diseases, hypertension, and osteoporosis.

 

 ○ Products to improve sex life and stamina.

 

 ○ Vitamins.

 

□ The consumers of food supplements include people of all ages with different financial capacities. Upscale consumers who belong to the higher income group have the ability to buy food supplements of more than $100 per month. Middle to upper-class consumers have the ability to buy at a range of $50 worth of food supplement products per month, whereas the rest are estimated to be consumers who spend less than $10 per month.

 

□ Korean companies should be aware that more than 90 percent of the Indonesian population is Moslems; therefore, health food products should comply with the Indonesia “halal” requirements. Indonesian consumers have an aversion to low-quality products and are attracted to branded products. They also tend to be image conscious and very price sensitive. Brand loyalty is most likely to be gained by products that are of good quality, well packaged, well-distributed, well-promoted and competitively priced, rather than by cheap products.

 

2. Market Size

 

□ According to National Agency for Drug and Food Control, was market performance for health food supplements in 2008 around US$ 313 million with contribution 80% by imported products. In 2012 total sales for health food supplements was US$ 1.6 billion. The average growth is 14 percent annually.

 

□ In addition, World Health Organization announced that the average spending per people in Indonesia for medicine increased from US$ 18 to US$ 125 per person associated with vastly growing of the middle class from only 37.7% in 2003 to 56.5% in 2010 along with the growing buying power. Beside the fact that Indonesian economic is growing there are another forces which support the food supplement business such as, the low quality of health in Indonesia and also many kinds of diseases which spread in many places. Indonesian Nutritionist Association published that the average height of Indonesia teenager is currently 6.7 cm less than it supposed to be.

 

□ There are two other conditions such as the obesity increment in the last few years and also many other complications. Positive news was announcement by Indonesia’s food and drug agency (BPOM) at the end of May 2013 that Indonesia has decided to adopt the terminology in the ASEAN harmonization regulation for traditional medicine health supplements(TMHS). The TMHS regulatory framework defines healthy food supplements and properly regulates health supplements as a sector. Indonesia has the biggest market with over 240 million population size and the highest rate of trade growth in ASEAN. By putting this regulation, Indonesia will have smoothed the pathway towards eventual implementation of the ASEAN harmonized regulations for this category, which is expected by 2015. At the moment healthy food supplements fall under either food or drug law, so it is not always clear where health supplements fall. A separate category for health supplements will give these products a clearly defined position.

The Origin Countries of the Import of Food Supplement into Indonesia

 

□ Food supplement products from the United States hold the highest import market share with over 70% share. The people of Indonesia consider the quality of American products to be of high standard and perceive that the American companies adopt the latest technology and adhere to strict health standard regulations.

 

□ American products have earned an excellent reputation and its competitive position for the next two years is very likely to remain the same, as consumers will continue to buy products that are familiar to them. Among those firms active in Indonesia are major American multi-level marketing firms, including Amway and Herbalife.

 

□ Other American suppliers present in the market include Nature’s Plus, Nature’s Bounty, Nutrilite, Wheat Grass, Forever Living, Herbalife, Nutrimax, and Sea Quill. These brands, however, are largely targeted toward upper-income consumers due to their high price and they are only available in a limited number of retail outlets, mainly in modern chain retail pharmacies such as Guardian.

 

□ Meanwhile, the majority of lower priced “high volume” brands come from a combination of multinational and domestic manufacturers. These brands are widely available from retailers throughout Indonesia, including the small grocery retailers.

 

4. Distribution

 

□ Imported health food supplements may only be distributed through a local agent or distributor. It is essential that Korean exporters confer with local agents or distributors to determine prevailing requirements on imports. The National Agency for Drug and Food (BPOM) regulates and controls the registration, distribution and quality of food supplements. The registration process takes around three to six months once the required documents are complete.

 

□ In Indonesia, commonly practiced distribution channels for health food products are:

 

 ○ Multi-level marketing (MLM), such as sales through member gets member program. This method can be successful in the Indonesian culture. Indonesians are very family-oriented and relationships are very important. Personal testimony on the benefit of products and personal relationships can be determining factors leading to a purchase.

 

 ○ Retail outlets, such as sold through retailers in supermarket, drug stores, and pharmacies. Wholesalers and distributors may contract for space on display counters at supermarkets and other retail channels, and provide their own sales promotion person to enhance the sale of their products.

 

□ Almost all consumer foods are imported by companies with an import license. Large entities, such as supermarket chain, have their own importing and distribution affiliates, although they also buy from independent importers.

 

□ Many food supplement companies are importing supplements in bulk into Indonesia for re-packaging. Most importers and agents/distributors adopt this method to reduce costs and the size, making them more affordable to the general public.

 

□ Creation of a strong brand through promotion is recommended for substantial entry into the market. Successful products tend to contain a unique formula or ingredients.

 

□ Business sources indicate that food supplement companies use print media as their primary advertising channels to promote imported food supplements. Other methods of promotion include television, radio or radio talk shows, and dissemination of printed materials at shopping outlets or display at pharmacies or health food stores.

 

□ Health food chains in Indonesia such as Century Health Care, Guardian, Medicastore, Boston Drugs, Melawai Drug Store (Apotik Melawai), Roxy Drug Store (Apotik Roxy), Kimia Farma Health Store (Apotik Kimia Farma), Natural Farm, Shop In, Plus Drug Store (Apotik Plus), Watsons and others.

 

□ Multi-Level Marketing business is played by tens of companies from small, middle to big companies. According to APLI (Asosiasi Penjualan Langsung Indonesia – Indonesian Direct Selling Association), now there are as many as 83 MLM companies. Some of them are already success in the market such as CNI, Amway, Kompak Indopola, K-Link, Capriasi, and Sophie Martin which have potential prospect to keep growing.

 

□ On APLI list, there are 54 Multi-Level Marketing companies distribute food supplement. CNI, Amway, Kompak Indopola, and K-Link are several MLM companies which success in distributing food supplement.

The regulation that governs the registration of food supplement is HK.00.05.41.1381. Food supplement is defined as processed food in a form of tablet, capsule, powder, granule, liquid or pill.

New registration:

1) Category 1: supplements containing one or more ingredients such as vitamins, minerals, amino acids, carbohydrates, protein, fat or other material in the form of isolates.

2) Category 2: supplements containing one or more ingredients such as vitamins, minerals, amino acids, carbohydrates, protein, fat or other material in the form of natural materials.

3) Category 3: supplements from category 1 and 2 with a new claim, new dosage form, posology, and new dosage.

 

Variation registration:

4) Category 4: supplements that have acquired distribution license with

                       i. Product’s name change only.

                       ii. Changes or additions to the packaging size.

                       iii. Claim changes on the labeling that do not change efficacy.

7. Usage, method of use, and usage dose.

8. Contra indication, side effect, and warning, if exist.

9. Distribution license number.

10. Batch/production code number.

11. Expiry date.

12. Other descriptions related with safety or quality or certain raw material in accordance with the existing regulation.

Labeling for imported supplement must use both Bahasa Indonesia and the manufacturer’s official language and must include the same information as the domestically manufactured supplement.

c. Importation License​

 

The Head of the National Drug and Food Control Agency (Badan Pengawas Obat dan Makanan – "BPOM") issued Regulation No. 27 of 2013 on The Supervision of Drugs and Food Imports into Indonesian Territory which came into effect on 28 May 2013. This Regulation repeals and replaces the previous regulations on Imports of Processed Foods, Cosmetics and Drugs.

 

The regulation controls the import of Drug and Food referred as drug, traditional medicine, quasi medicine, cosmetics, health supplement, and processed food. The regulation stated that :

 

ü Drug and Food that can be imported into the territory of Indonesia for circulation is Food and Drug that has obtained circulation permit.

ü Importation of Drug and Food also has to obtain approval from the Head of the Agency (BPOM).

ü Approval from the Head of the Agency is in the form of an Import Certificate (Surat Keterangan Impor – "SKI") which is only valid for one time importation.

ü Drug and Food imported into the territory of Indonesia must have a shelf life of at least:

7. 1/3 (one - third) of the shelf life for Drug, Traditional Medicine, Quasi Medicine, Health Supplement, and Cosmetics;

8. 9 (nine) months prior to Expiration Limit, for Biological Product;

9. 2/3 (two - third) of the shelf life, for Processed Food

ü SKI also applies for the importation of Drug and Food into the Free Trade and Free Trade Area

ü Importation of Drug and Food can only be performed by the holder of Circulation Permit or its proxy.

ü Procedure to get SKI:

10. Applicant that will apply for SKI must register using the Single Sign On mechanism to obtain an account in the form of user ID and password.

11. The Single Sign On mechanism is to obtain login access to the Agency of Drug and Food Control in-house (including Main Office/POM Office) and the Indonesia National Single Window portal.

12. Registration is conducted through the website of the Agency of Drug and Food Control at http://www.pom.go.id or through the sub site http://www.e-bpom.pom.go.id.

13. Applicant performs data entry electronically and submits the supporting documents by uploading it into the e-bpom application.

14. Registration shall be equipped document as follows:

 

o  Original Application Letter signed by the Director or the Proxy of Director and duly stamped;

o  Duly stamped Original Letter of Statement of the Responsible Person;

o  Photocopy of Import Identification Number (API);

o  Photocopy of Trading Business Permit (SIUP);

o  Photocopy of the Tax Identification Number (NPWP);

o  Photocopy of Importation Letter of Authorization in the form of General Certificate by Notary, in the case where the application is a company that has been authorized for import;

o  Pharmaceutical Industry Permit in case of Drug importation;

o  Permit of PBF (Pharmaceutical Wholesaler), for PBF that has been authorized by the pharmaceutical industry to conduct importation of drug;

o  List of HS Code that will be imported.

ü For verification purposes, the applicant must show the original documents.

ü In case the verification result is complete and correct, applicant will be given a user ID and password.

ü Registration of applicant only needs to be performed 1 (one) time, as long as there is no change in applicant data.

ü SKI is issued based on application. SKI application must equip with the following electronic documents:

o  Approval of Circulation Permit

o  Certificate of analysis;

15. Product name stated on the invoice has to be the same as the product name stated on the Distribution Permit, except for cosmetics;

16. In the case of cosmetics as intended in item a does not have to be the same as the name stated in the Distribution Permit, hence it must be equipped with information letter from the producer.

 

□ The SKI will be issued within one working day of the SKI application requirements being fulfilled. SKIs are issued in electronic form (paperless) and can be printed out by the applicant company if necessary, or manually in the event of force majeure or at POM Centers (Balai Besar/Balai POM) that have not yet been equipped with the Indonesia National Single Window system.
