2. Import Duty

 

□ According to Indonesia Customs Tariff Book, HS Code heading 2103.90 is described as follows:

□ Import duty tariff under the framework of ASEAN-Korea Free Trade Area(AKFTA) is lower than the import tariff entry that applies in general,. Those are imposed on imported goods which include the Certificate of Origin (Fonn AK) which have signed by the competent authorities in the countries concerned. In case the general import duty tariff is lower than in the ASEAN-Korea Free Trade Area (AKFTA) as contained in the Appendix, the general tariffs rate is applied.

 

3. Import Process to Indonesia

 

□ There is no separated regulation regarding the import of frozen food and retort pouch product, yet there are two regulations concerning food import to Indonesia.

 

□ Legal basis:

 

 ○ Regulation of Ministry of Trade Republic of Indonesia No.24/M-DAG/PER/9/2011 on ”Terms and Conditions of Import and Export of Animal and Animal Products”;

 

 ○ Regulation of BPOM (The Indonesia National Agency of Drug and Food Control) No. HK.00.05.1.23.3516 on “Circulation Permit on Medicine, Traditional Medicine, Cosmetics, Food, and Food Supplements that are Sourced, Contain Certain Material and or Alcohol”;

 

 ○ Regulation of BPOM No.27 Year 2013 on “Entry Control on Food and Drug into Indonesia”.

 

□ Import regulation

 

   Foods that can be entered into Indonesian territory to be circulated is the Food that has distribution permit.

 ○ Food entry should have SKI (Import Certificate – Surat Keterangan Impor) and be approved by the Head of the importation of Food and Drug Administration BPOM.

 ○ SKI is only valid for one entry. Importers must apply for a SKI on each importation.

 ○ To get SKI

  - Online registration through BPOM Website http://e-bpom.pom.go.id/

  - SKI request shall be equipped document as follows:

   · Certificate of Analysis (CoA); Please include bets, lot, production date, and expire date

   · Safety Data Sheets and/or Specifications of Materials

   · A Statement of the purpose of use

   · Invoice

   · Packing list

   · Bill of Landing (B/L) or Air Way Bill (AWB)

   · Proof of Payment of non-tax revenue

 

 ○ SKI is published in electronic form and does not require wet stamp and signature (paperless).

 

 ○ SKI can be printed by the applicant or any other agency stakeholders through a system of Indonesia National Single Window (INSW) http://www.insw.go.id/

 

 ○ The Processed Food which entered into Indonesian territory must have a storage period at least 2/3 (two thirds) of the exact storage period.

 

□ Circulation permit

 

 ○ Circulation permit is a form of registration approval for medicine, traditional medicine, cosmetics, food supplement, and food products issued by the Drug and Food Control Agency of the Republic of Indonesia so that the products can be legally circulated within the territory of Indonesia.

 

 ○ Food products and/or drinks are processed food achieved from a process using certain methods with or without additional substances.

 

 ○ Certain substances are substances containing or originating from animals or other living beings solely by itself or a mixture or processed product or its derivative excluding bee honey, or in its process, got in contact with certain substances. These are covered: pig, dog and offspring born from their inter-marriage;

 

 ○ Food products and drink products from, containing or originating from certain substances shall not be given a circulation permit.

 

 ○ Exempted from the provisions as intended above food products and drink products from, containing, or originating from pig may be provided with a circulation permit on condition it must meet requirements on safety, quality, and nutrient, and labels of the food products are also required to include the inscription and picture "containing pig + picture of pig" in its box in red colour on a white colour base as shown in the sample:

 

 ○ The inscription “CONTAINING PIG” as intended above must meet the following provisions:
